GENERAL TERMS OF SERVICE

1. Introduction and scope

These General Terms of Service (hereinafter "GTS") set out the rights and obligations between Facile Solution SRL (hereinafter the "Publisher") and the Subscriber regarding the provision of paid services accessible via the website Swingro.com (hereinafter the "Site").

The GTS apply to all Subscriptions taken out by adult natural persons residing in eligible territories. They are available on the Site and may be amended unilaterally by the Publisher. Any change will be notified one (1) month before it takes effect.

2. Definitions

  • Subscriber: Any natural person aged 18 or over who has taken out a Subscription for personal purposes.
  • Subscription: The contract between the Subscriber and the Publisher granting access to the Specific Services after payment.
  • Specific Services: Benefits and features detailed in section 4, including access to the Press Kiosk and other exclusive benefits.
  • Account: Personal space created by the Subscriber on the Site, secured by a username and password.
  • Personal Data: Information collected and processed in accordance with the Privacy Policies.
  • Press Kiosk: Digital catalogue including press, magazines and novels accessible via a third-party partner.

3. Description of the Specific Services

The Subscription offers:

  1. Unlimited access to the Press Kiosk
    • Continuously updated digital catalogue, provided by a third-party partner (YouScribe).
    • No physical books are distributed.
  2. Exclusive member benefits
    • Discounts of up to 50% on the online store.
    • Free shipping on all products.
  3. Details and availability
    • The Specific Services are accessible exclusively via the Subscriber's personal Account.
    • Username and password confirmation by email upon subscription.

4. Subscription process

  1. Account creation
    • The Subscriber must provide personal details (email address, password, other information).
    • Only one registration per person is allowed.
    • The Subscriber is responsible for keeping their details up to date.
  2. Subscription validation
    • Subscription via the Site, after logging in to the Account.
    • Acceptance of the GTS by ticking the dedicated box.
    • Secure payment by bank card (debit card, Visa, MasterCard).
  3. Confirmation
    • A confirmation email is sent after payment validation.

5. Subscription term and termination

  1. Initial term and renewal
    • The Subscription is concluded for a period of 30 days, tacitly renewed each month.
  2. Termination procedure
    • Notification via the Site contact form or by email (contact@Swingro.com).
    • For termination effective at the end of the current month, the request must be received before the 15th of the month.
    • If a charge has already been taken, access to the Specific Services remains active until the end of the following month.
  3. Suspension or early termination by the Publisher
    • In case of breach of the GTS (fraud, non-payment, etc.), the Publisher may suspend or terminate the Subscription immediately, without compensation.

6. Price and payment

  1. Applicable prices
    • Trial period: 3 days
    • Monthly subscription: 45,90 €
  2. Payment methods
    • Payment by bank card only. PayPal and American Express are not accepted.
  3. Price changes
    • The Publisher reserves the right to change prices with two (2) months' notice.
    • The Subscriber may terminate free of charge if they disagree with the new price.
  4. Payment undertaking
    • The Subscriber warrants the validity of their payment method and accepts automatic monthly charges.

7. Service availability

The Specific Services are available immediately after payment validation, from the Subscriber's personal Account. The Publisher does not guarantee uninterrupted availability and disclaims liability for temporary interruptions due to maintenance.

8. Right of withdrawal

  1. Period and exercise
    • The Subscriber has 14 days to exercise their right of withdrawal.
    • Notification via the Withdrawal Form (Annex 1) by email or post.
  2. Conditions
    • If the Subscriber requested immediate access to the Services, they must pay an amount proportionate to actual use of the Services up to the date of withdrawal.

9. Personal data

Data collected are processed in accordance with the Privacy Policies. The Subscriber has the right to access, rectify and erase their personal data.

11. Miscellaneous

  1. Electronic correspondence
    • Email communications are binding between the parties.
  2. Partial invalidity
    • If any clause of the GTS is held invalid, the remaining clauses remain applicable.

12. Applicable law and disputes

The GTS are governed by Belgian law. In case of dispute:

  1. Attempt at amicable mediation within one (1) year via an accredited mediator.
  2. If no agreement is reached, recourse to the competent courts.
